CNSM DECLARATION regarding the anticipation of numerous redundancies following the reform of the Government of the Republic of Moldova

The National Trade Union Confederation of Moldova notes with concern that as a result of the Government’s reform, hundreds of employees currently employed in the respective public authorities, will no longer find themselves in the new structure of the public administration system and will therefore complement the ranks of unemployed.

Their socio-economic situation could become even more complicated by the underemployment of the labour force, which would encourage informal employment, which remains high, as well as labour migration.

Starting from the above mentioned, the National Trade Union Confederation of Moldova asks the Parliament and the Government of the Republic of Moldova that the measures taken to achieve the reform of the public administration should be based primarily on the principle of opportunity, social equity and protection of the legitimate rights and interests of the employees subject to redundancy, to identify the appropriate measures and legal instruments that would ensure to the full extent compliance with the procedure for dismissing employees and ensuring all their rights and guarantees of work.

According to art. 88 of the Labour Code, the National Trade Union Confederation of Moldova requests the Government of the Republic of Moldova, in case of reorganization of the central administrative authorities and the authorities subordinated to them and mass reduction of the work places, to provide written information about this by the public authorities at least 3 months in advance, to the primary and branch trade union organizations and initiate collective bargaining in order to respect the rights and interests of employees, including civil servants, in accordance with the particularities of their legal statutes.

The National Trade Union Confederation of Moldova expresses firm conviction that the Parliament and the Government of the Republic of Moldova will consider the issue addressed by the present Declaration and will not admit violations of the rights and interests of the employees in the process of reforming the public administration system.

Trade unions will closely monitor the respect of the rights and interests of redundant workers on the grounds of reducing their number.
