Trade unions expose on “Remote work”

The National Trade Union Confederation of Moldova (CNSM) is willing to support the elaboration of proposals to amend the Labor Code on the regulation of the conduct of remote labor relations.

With reference to the draft Law amending the Labor Code of the Republic of Moldova no. 154/2003 in order to complete it with a new chapter – “Remote work”, CNSM considers that this is a reproduction of Chapter IX of Title X of the Labor Code – “Work at home”.

Thus, we expose on the need for improvements on this new Chapter regarding:

  • keeping records of working hours, actually provided by the employee;
  • assuring the employee’s compliance of the legal regulations related to working time and rest time;
  • ensuring by the employer the safety and health requirements at work, as well as monitoring the employee’s compliance with them;
  • the manner of ensuring the control and supervision of the employer by the supervisory bodies in order to ensure and comply with the safety and health requirements at work;
  • determining liability for breaches of occupational safety and health requirements, as well as assuming the consequences of non-compliance by the parties to the employment relationship.

In this regard, in order to remove the gap in labor law on these issues, we consider it appropriate that the proposals in the draft law be examined in the tripartite working group, created under the auspices of the Ministry of Health, Labor and Social Protection. An address in this regard was sent to the Minister of Health, Labor and Social Protection on April 6. We don’t have an answer or a resolution yet.
