Social dialogue partners – Government, trade unions and employers – gathered on Wednesday, November 7, at a new meeting of the National Commission for Collective Bargaining and Consultation (CNCNC) to discuss several draft laws and other important issues included on the agenda.
During the CNCNC meeting, the social partners examined the draft of the State Budget Law for 2019 issued by the Ministry of Finance and declared their support for the given project, which is to be submitted for approval to the Government of the Republic of Moldova. At the same time, the Commission examined the draft Law on the State Social Insurance Budget for 2019, as well as the draft Law on the compulsory health insurance funds for 2019, submitted by the Ministry of Health, Labour and Social Protection.
CNCNC members approved the Framework Regulation on the organization and functioning of bipartite collective bargaining consultations and negotiations Commissions. Bipartite Branch Commissions have an advisory role in developing socio-economic strategies and policies, as well as in settling conflicting situations between the social partners at branch level.
The participants at the meeting analysed the work of the control bodies regarding the observance of the provisions included in the collective labour agreements and the collective agreements at national, branch and territorial level. In this respect, according to the Labour Inspectorate data, in the period 2017-2018, 5078 controls were carried out, as a result of which 37926 violations and deviations from the provisions of the legislation in the field of labour relations were identified and prescribed more than 30 thousand compliance measures.
Although the trade unions and representatives of the Ministry of Health, Labour and Social Protection insisted on the need to ratify the International Labour Organization Convention no. 161/1985 on Occupational Health Services, which will facilitate the provision of occupational health services in institutions and businesses, in order to protect the health of employees, this subject has not been approved and is to be further analysed.
Those present also examined the issue of compliance with the provisions of the Government Decision no. 165/2010 regarding the minimum guaranteed salary in the real sector and the issue of local taxes for the name of the locality.
