Units, irrespective of the type of ownership and legal form of organization, will be advised to conclude individual employment contracts for the duration of a particular job if the setting of an exact time to complete the work is not possible. This provision is contained in the Collective Agreement on the Individual Employment Contract for the Term of Work, which was approved today, 25 May, at the National Commission for Consultation and Collective Bargaining by the social partners: Government, Employers and Trade Unions.
I recall that the model of the respective Convention was discussed and submitted to the social partners for examination and promotion at the meeting of the CNSM Confederal Committee of March 29. By implementing the collective agreement on the individual employment contract for the period of accomplishment of a certain work, in the opinion of the author, the CNSM, it will improve the process of regulating the labor relations, will be able to count on the observance of the legal rights and interests of both parts of the work relations, on the efficiency of the activities of diminishing and eradicating informal work.
In other words, the social partners focused largely on the subject of measures taken to reduce informal employment and the phenomenon of wages “in envelopse”. On this occasion, Oleg Budza, President of the CNSM, said that diminishing and fighting the informal economy is one of the dominant, constant trade union priorities. The CNSM aims as a permanent strategic objective to increase the accumulations in the state budget, in the state social insurance budget, in the compulsory insurance funds, which will allow the increase of salaries, pensions , expanding and improving medical services.
As a sure premise in terms of achieving those targets that would provide better living for people and decent working conditions for employees, Oleg Budza noted, would be the creation of trade union organizations at institutions, enterprises. As the CNSM president expressed, where the trade unions are active, the phenomenon of informal work is not attested. Since trade unionists insist on the conclusion of collective and individual contracts, which make “informal work” and wages “in the envelopes” impossible. On this occasion, he reiterated that the CNSM initiated the “Collective Labor Agreement – the Guarantee of Your Rights” Campaign, which includes several clauses related to wages, safety and health at work, etc.
CNSM president outlined several considerations that would lead to the efficiency of the activities of diminishing and eradicating informal work. First, the president of the CNSM insisted that the ILO recommendation on the transition from the informal to the formal economy into the national legislation to be promoted and applied. Also, Oleg Budza once again called on trade unions’ request to raise the country’s minimum wage to the subsistence level and index it according to the inflation rate.
In the end, the trade union leader has declared on the necessity to tighten the punishment for employers who use informal work, to stimulate the payment of wages by bank cards, transfer; to use the experience from abroad to reduce and combat informal work.
