The CNSM Confederal Committee, during today’s meeting on December 21, approved the Recommendations on the Application of Amendments to the Labour Code of the Republic of Moldova, which were introduced by Law No.188 of 21 September 2017.
Sergiu Sainciuc, vice-president of the CNSM, explained that through these recommendations, the trade union bodies in the country are encouraged to pursue certain actions aimed at balancing the negative or unfavourable consequences of the recent amendments and additions to the Labour Code of the Republic of Moldova.
The CNSM vice-president stated that the Recommendations aim to monitor the correctness of the application of disciplinary sanctions, to initiate collective negotiations and to introduce clauses in the collective labour agreements concerning the fight against illegal work, the issuance of nominal allowances to employed employees, the action of the collective labour agreements, the maintenance of the register of the individual labour contracts, banning the probationary period for employees, the dismissal of employees on grounds of having a pensioner status.
At the same time, the trade union bodies are proposed, as the case may be, to initiate collective negotiations on the completion of the internal regulation of the unit with provisions specifying certain mechanisms of unit management, such as the employment and redundancy of the employee, the manner of applying the disciplinary sanctions and other provisions that would not allow employees’ rights and guarantees to be violated.
The materialization of these Recommendations will have the effect of streamlining the work of the trade union bodies in order to protect employees, trade union members, from the point of view of labour relations.
