Trade unions are calling for a deadline to examine the collective labour dispute in the Conciliation Commission

Today, 21 December, the Confederal Committee of the National Trade Union Confederation of Moldova adopted a decision requesting the Moldovan Parliament to examine the proposal of the CNSM to initiate the procedure for amending and supplementing Articles 359 and 360 of the RM Labour Code. Thus, in the CNSM editorial, paragraph 8 of art. 359 should have a new content, namely to stipulate that the conciliation commission conciliates the parties to the labour conflict within maximum 10 working days from the date of its constitution. According to the trade union initiative, the deadline may be extended by a joint agreement of the Conciliation Commission with a maximum of 5 working days.

Also, the proposal of the CNSM of amending and supplementing the Labour Code of RM assumes that if the members of the conciliation commission reached agreement on claims submitted by employees’ representatives, the commission will take a decision binding on the parties to the conflict and will remit it to them within 24 hours of the adoption.

According to Sergiu Sainciuc, vice president of CNSM, by this amendment of the Labour Code of the RM is aiming at improving the conciliation of labour disputes and eliminating situations of abuse in the context of a decision delaying the collective labour conflict. At the same time, the members of the respective commission will be responsible for the adoption of a decision within the deadline set by the Labour Code. The most important thing is that the rights and interests of employees and employers are respected. And, finally, it will be possible to effectively implement the legal provisions on solving labour conflicts.

Through this approach, the CNSM also requests that paragraph (1) of art.360 of the Labour Code of the Republic of Moldova to be supplemented by the provision that when the parties to the conflict do not come to an agreement or do not agree with the decision of the Conciliation Commission, each of them may file an application for settlement of the conflict within the court within 10 days of “the expiry of the term for conciliation of the collective labour dispute by the Conciliation Commission or as the case may be”.
